o Senate Judiciary Committee Hearing Covers Webcasting Royalty Debate
Washington -- A U.S. Senate Judiciary Committee hearing on Wednesday
focused on the proposed royalty rates for webcasters streaming music
online. Many small webcasters have argued that the rates, which were
devised by a Copyright Arbitration Royalty Panel (CARP), are so high that
they would force their stations off the air. Those testifying at the
hearing included Recording Industry of America (RIAA) chairman and CEO
Hilary Rosen, Digital Media Association executive director Jon Potter, an
independent webcaster and artist Dan Navarro. "We believe that the
recently completed CARP proceeding was fair.three-and-half years after
Congress first created this new compulsory license we look forward to the
implementation of the arbitrators' decision so that record labels and
artists can be finally compensated," the RIAA's Rosen said in her
testimony. Potter, whose organization represents the interests of a number
of webcasters, testified that, "The CARP-recommended royalty is
astronomically high, and bears absolutely no rational relationship to
traditional copyright licensing benchmarks." Webcasters argued at the
hearing that to stay in business, a royalty fee based on a percentage of
their overall revenue rather than a per-listener, per-stream fee is
needed. The submitted testimony of all witnesses is provided at a link

May 21.

o Sonicblue Granted Stay of Ruling Requesting Monitoring of ReplayTV
Users
Santa Clara, Calif. -- Consumer electronics firm Sonicblue announced on
Wednesday that a U.S. federal court has granted a stay of a federal
magistrate's ruling that would have made the company monitor the viewing
habits of owners of its ReplayTV personal video recorder. A number of film
studios and TV networks sued Sonicblue for copyright infringement over
ReplayTV's ability to skip through commercials and send recordings of TV
shows over the Internet. The plaintiffs asked for information from
Sonicblue on how its customers were using the device, which would require
the company to modify its product and monitor its customers. A number of
organizations -- including the Electronic Privacy Information Center and
Consumer Electronics Association -- have filed amicus briefs in the case
on Sonicblue's behalf, arguing that the request is a violation of ReplayTV
owners' privacy. "We are pleased that the court has granted this stay
and
look forward to a full hearing in this matter," said Ken Potashner,
president and CEO of Santa Clara-based Sonicblue.

o More Napster Execs, Founder Shawn Fanning Depart; Staff Offered
Severance
Redwood City, Calif. -- Following Napster CEO Konrad Hilbers'
announcement
on Tuesday that he would resign following a failed buyout bid from
Bertelsmann, a number of other executives and Napster founder Shawn
Fanning have also left the company. The New York Times reported that
general counsel Jonathan Schwartz, as well David W. Phillips, vice
president for service and product management, and executive vice president
Milton E. Olin Jr. also resigned. Several outlets reported that Napster
employees were given the option of taking a voluntary severance or a week
of unpaid vacation in hopes that new funding for the company would emerge.
"It's incredibly disappointing. People here still believe in the
potential
of Napster to run as a fee-based service," former Napster employee
Alex
Rofman told The San Jose Mercury News. "The technology is great. We
had
built a brand new system, we completely rewrote the system and it worked.
It's unfortunate." Most believe the company will now file for
bankruptcy,
which would temporarily halt the long-running copyright infringement
lawsuits filed against Napster by the recording industry.

o In Response to Sony, Microsoft Cuts Price of Xbox to $199
Redmond, Wash. -- In response to Sony Computer Entertainment's
announcement yesterday that it would cut the price of its PlayStation 2
video game console by a third to $199, Microsoft on Wednesday announced
that it would follow suit and reduce its Xbox console in price from $299
to $199. The news brings the price of all three competing consoles, which
also includes Nintendo's GameCube, to $199, and pressures Nintendo to
further cut the price of GameCube to maintain its advantage. "The
traditional forum for making an announcement of this magnitude is the
Electronic Entertainment Expo (E3) next week, but we've been ready to go
for some time and can easily put this in place at retail now," said
O'Rourke, director of worldwide Xbox marketing at Microsoft. "We see
no
reason why eager gamers should have to wait a week to benefit from this
tremendous value opportunity." Microsoft also announced on Wednesday
it
will open an additional Xbox manufacturing plant in China in conjunction
with outside manufacturing firm Flextronics. The company will also move
its Hungarian Xbox plant to China while maintaining its Guadalajara,
Mexico facility. Microsoft said it plans to open an additional Asian
manufacturing plant for Xbox later this year. "We are extremely
satisfied
with our relationship with Flextronics," Todd Holmdahl, general
manager of
Xbox Hardware for Microsoft.

o Study: Growing Population of Adults Streaming, Downloading Music
San Francisco -- Nearly one out of every three adults have either
downloaded music or have listened to streaming music from the Internet at
least once, according to a consumer technology purchasing study released
on Wednesday by San Francisco-based venture capital firm Venture Strategy
Partners. Of this number, nearly one-third say they download music often.
The study found that while younger adults remain the most prevalent
listeners, the baby boomer generation (age 35-54) represented 35 percent
of the total listening audience. The study also found that one in four
adults would pay to subscribe to an online music service, where $15 for 50
songs per month, or $12 a month for an unlimited streaming service was
deemed "reasonable." "The findings clearly point to a
growing market of
online music consumers who are increasingly willing to pay for a
service,"
said Tony Conrad, general partner of Venture Strategy Partners. "The
real
challenge is for content and distribution providers to develop both a
dominant brand and an acceptable business model to access and serve this
market."

o Kazaa Piggyback Network Creator Brilliant Digital Raises $1.25
Million
Los Angeles -- Brilliant Digital Entertainment, a developer of 3D media
creation and ad serving technologies, announced on Wednesday that it has
recently raised $1.25 million through the combination of a private
placement and the sale of common stock and warrants. Los Angeles-based
Brilliant Digital said the funds would go towards sales of its rich media
Brilliant Banner ad format and contribute to the further development of
its Altnet secure peer-to-peer network. The company secured a deal with
Sharman Networks, owner of the Kazaa file-sharing service, to distribute a
second network along with installs of the Kazaa software that will launch
a separate network on Kazaa users' computers. The second, opt-in network
will allow Brilliant Digital to distribute secure music or offer the
networked PCs' collective processing power for third parties' distributed
computing projects.

o Cato Institute: Digital Rights Management Doesn't Affect "Fair
Use"
Washington -- A new study released by non-profit public policy research
foundation the Cato Institute reports that digital rights management (DRM)
technologies, when implemented with digital audio subscription services,
do not hamper consumers' traditional "fair use" rights of media.
Some
argue that the introduction of digital rights management technologies,
which limit how consumers may use songs they have paid for, strips them of
traditional "fair use" rights to copy or transfer them. The
report,
written by University of Texas at Dallas economics professor Stan
Liebowitz, argues that, "by charging for each minor instance of
use...
this extreme form of DRM becomes, virtually, an instance of what
economists refer to as 'perfect price discrimination,' wherein each user
is charged a price strongly related to his willingness to pay."
However,
Liebowitz argues that Sen. Hollings' (D-S.C.) bill that would put
government-mandated copy-protection in consumer electronics devices, is
misguided. "There is no need to have the government certify which
security
technologies are to be used or to force a decision on market participants
regarding the choice of which, if any, of these technologies should be
used."

o Digimarc Watermarking Patents Affirmed in Dispute with Rival Verance
Tualatin, Ore. -- Digimarc, a developer of digital watermarking
technology
for digital media, announced on Wednesday that the U.S. Patent Office has
re-affirmed one of its patents, bringing the number of its total patent
claims to 45. The company is suing rival Verance Corp. for copyright
infringement of four of its patents on technology that embeds inaudible or
invisible copyright information into audio and video to track
transmissions and help prevent piracy. "This Patent Office action
concludes the third patent re-examination out of four related to
Digimarc's pending patent infringement litigation against Verance
Corporation," said Bill Conwell, Digimarc's vice president of
intellectual
property. "For a third time, re-examination has concluded with an
expansion of the number of claims infringed by Verance." The Patent
Office
is continuing its examination of the fourth Digimarc patent.

that it will support Sony's online initiative for its PlayStation 2 video
game console by adding online features to its "Madden NFL 2003,"

games based on United Artists' "Rocky" series of boxing films.

been discovered to circumvent the CD copy-protection technology developed
by Israeli firm Midbar Tech. The method involves placing electrical tape
around a certain portion of the CD, which contains a data track that makes
the CD unreadable by CD-ROMs and other computer drives. The tape covers up
this data, and the drive then moves on and can play and rip the music
tracks on the disc.
