o German Authorities to Prosecute
3,500 Music File-Swappers
Cologne, Germany - German authorities have launched
criminal proceedings against 3,500 music file-swappers on the
eDonkey peer-to-peer network, according to a report from the
International Federation of the Phonographic Industry (IFPI), a
record label trade group. The IFPI said German police on Tuesday
searched 130 premises to gather evidence in its investigations,
which have been underway for several months under the auspices of
the Public Prosecution Service of Cologne and the Police Authority
of Bergheim. Each individual faces both criminal prosecution and
claims of up to several thousand dollars for uploading songs onto
eDonkey. "No one should be surprised that we are stepping up our
campaign in this way," said IFPI chairman and CEO John Kennedy. "The
music industry has run numerous education campaigns aimed at
audiences from parents to schools and internet users. Internet
piracy has hurt the whole music community in Germany, with
legitimate sales falling by a third in just five years."

Kit, is a wireless system that will relay information on time,
distance, calories burned and pace from a sensor inside Nike Air
Zoom Moire and other footwear to an iPod Nano, which will then
provide real-time audible feedback through the headphones. The sport
kit will retail for $29 when it goes on sale in two months.

o BSA
Encouraged by Drop in Software Piracy Rate in Emerging Economies
Washington - Though the worldwide rate of software piracy
remained unchanged in 2005, the rates in emerging economies such as
China, Russia and India improved, according to a new report from the
Business Software Alliance (BSA), an association of some of the
world's largest software developers. The BSA said that 35% of the
packaged software installed on personal computers worldwide was
illegal, amounting to $34 billion in global losses, piracy rates
decreased moderately in more than half (51) of the 97 countries
covered in the study. "The progress made in reducing PC software
piracy in several emerging markets provides some encouragement;
however, much more needs to be done," said Robert Holleyman, the
president and CEO of the BSA. Piracy rates in Russia and China each
dropped 4%, while the rate in India fell 2%.

o XM
Satellite Radio Terminates Deal to Acquire WCS Wireless
Washington - After failing to gain the necessary
government approvals, XM Satellite Radio, a provider of satellite
radio service to more than 6.5 million subscribers, said that it has
terminated its planned acquisition of WCS Wireless, a Nevada-based
owner of wireless spectrum licenses in geographic areas covering 163
million people throughout the U.S. The deal, which was worth about
$200 million when announced last July -- but has since seen its
value fall significantly with XM's dwindling share price -- was
supposed to give XM the resources to launch a variety of new video
and data offerings. Without regulatory approval, however, the two
sides agreed to terminate the deal, freeing WCS to pursue other
alternatives for its spectrum. The news sent shares of XM down 3.8%
on Tuesday.
