o EarthLink Launching on AOL Time Warner Cable Systems
Atlanta -- Internet service provider EarthLink announced on Monday that
it
will begin providing cable modem high-speed Internet access on lines owned
by Time Warner cable systems in Columbus, Ohio and Syracuse, New York in
September. The companies also said that EarthLink will launch "a
substantial number" of additional Time Warner cable systems by the
end of
the year. AOL Time Warner was compelled to open up its high-speed cable
lines to third parties as part of anti-trust measures related to AOL's
purchase of Time Warner. Atlanta-based EarthLink also has agreements with
cable operators Comcast, Cox and AT&T Broadband to access their cable
lines to provide broadband Internet access to consumers.

o MusicMatch Settles Litigation, Secures License With RIAA
San Diego --Music jukebox software developer MusicMatch said on Monday
that it has signed a licensing agreement with the Recording Industry
Association of America (RIAA) for music performances on its Web radio
service. Financial terms of the agreement were not disclosed. As a result
both sides have agreed to drop pending litigation against one another. The
litigation stemmed from the RIAA's belief that MusicMatch's webcasting
service was in violation of the Digital Millennium Copyright Act (DMCA)
because it was termed too "interactive" -- in that users had too
much
control over what music was played on the station. San Diego-based
MusicMatch's new license with the RIAA deems it a
"non-interactive"
station that qualifies for a blanket license for all of the
RIAA-represented major labels' songs. MusicMatch also announced Monday
that TVT Records founder and CEO Steve Gottlieb has been appointed to its
board of directors.

o FullAudio Gets License from EMI for Subscription Service
Chicago -- FullAudio, a company developing a subscription service for
digital music, announced on Monday that it has been granted a
non-exclusive license to use recordings owned by EMI Recorded Music in its
planned subscription service. Terms of the agreement were not disclosed.
Chicago-based FullAudio has already secured publishing rights to songs for
its service from a number of publishers, including EMI Music Publishing
and BMG Music Publishing. FullAudio CEO Chris C. Gladwin told the New York
Times that the company plans to launch its service within 90 days to
compete with the planned launches of competing subscription services from
MusicNet and Pressplay. FullAudio's service will download selected songs
into a cache on the subscriber's computer -- which can only be accessed as
long as the subscriber's account is paid up to date -- and allows them to
be listened to while the user is off-line. The songs can also be
transferred to portable devices such as MP3 players.

o Briefly Noted:
(Redwood City, Calif.) Napster has posted a 53-page transcript on its
website of last week's closed-door session with Judge Marilyn Hall Patel
and the RIAA, that ended with the judge ordering the file-sharing service
shut down until its filters are 100 percent effective. Judge Patel agreed
to allow its publication after the company lobbied that the public needed
to know more about the ongoing proceedings. Webnoize reported that the
RIAA is now seeking to expedite its case against the company by asking the
court for a summary judgment, which would assume Napster's guilt and
preclude the necessity for a lengthy trial.

(Los Angeles) Rap group Public Enemy announced an online contest Monday
that gives fans and amateur producers the chance to contribute their own
music to an upcoming PE album on Chuck D's SlamJamz.com label. Visitors to
the website can download several vocal tracks, create their own music to
accompany the vocals, and then upload the completed tracks back onto the
website. Several of the mixes will be included on the upcoming album --
which will be released in the fall -- with the amateur producers retaining
co-ownership rights and earning royalties from the sale of each copy.

(Los Angeles) Musician David Bowie has launched a Web radio station for
children, aptly titled "Kick Out the Jammies." The site resulted
from
Bowie's creating mix tapes for his 11-month-old daughter Alexandria, and
offers some of Bowie's own music along with classical selections and
sing-alongs. "I was putting together tapes to play while Alex took a
bath
or had breakfast or... and it occurred to me that it would be a nice thing
to put together a station’s worth of stuff for kids," said Bowie.
