o XM Files to Have Record Industry Copyright Suit Tossed Out

Washington - XM Satellite Radio has asked a federal judge to dismiss a copyright infringement lawsuit brought by the Recording Industry Association of America (RIAA), which targets new radios that can record XM broadcasts, the Associated Press reported. The record labels sued XM in May over the "Inno," a new satellite radio that can record broadcasts and organize them by artist and individual songs. In its court filing this week, XM argued the device is covered by the 1992 Home Recording Audio Act, which exempts devices that can make copies of copyrighted media for private use. "If XM wants to compete with iTunes, Rhapsody and similar music distribution services, it needs to obtain the appropriate authorization," the RIAA's Jonathan Lamy told AP, referring to the licenses such services pay to sell permanent downloads of individual songs. Separately, the Consumer Electronics Association and Home Recording Rights Coalition on Monday filed a joint brief in the case supporting XM's argument.

o Time Warner Considering Sale of AOL U.K. to British Sky Broadcasting

Dulles, Va. - Media giant Time Warner is in talks to sell its AOL U.K. unit to News Corp.'s British Sky Broadcasting Group (BskyB), according to several published reported on Tuesday. The move would reportedly be part of AOL's transformation to an advertising supported model, rather than a subscription service. Reuters reported that James Murdoch, the CEO of BskyB, confirmed his company's interest in the unit, but also warned that his company is "not interested in paying high prices." He said, "We would look at it from an opportunistic basis."

o Report: Google Continues to Widen Lead in Internet Search Market

Reston, Va. - Internet search giant Google gained market share for the 11th consecutive month in June, according to new figures from Internet audience measurement firm comScore Networks. For the month, Google conducted 45% of all U.S. Internet searches, up about 8% from the previous year. Yahoo (29%) and MSN (13%) followed in second and third place, respectively. Google and Yahoo also combined to control 95% of the toolbar search market. In all, Americans conducted 6.4 billion searches in June.

o THQ Forms New Game Development Studio in Southern California

Agoura Hills, Calif. - Video game publisher THQ announced on Tuesday that it has formed a new development team, Incinerator Games, which will be based in Carlsbad, Calif. The studio will be comprised of developers from Sony's 989 Studios ("Twisted Metal," "NFL GameDay") and Take-Two's Rockstar Games ("Midnight Club"). Agoura Hills, Calif.-based THQ said Incinerator will focus primarily on titles for next-generation consoles, and is currently at work on next-generation console versions of THQ's game based on the Disney/Pixar film "Cars," and other next-generation titles. Separately, THQ announced on Tuesday the release of its "Monster House" title, based on the Columbia Pictures film that opens in theaters on July 21. The game is available for PlayStation 2, Nintendo GameCube, Game Boy Advance and DS.

o Fans Asked to Submit Cover Art Online for New Janet Jackson Album

New York - Virgin Records and Yahoo Music on Tuesday announced a promotion that encourages fans to submit their own designs for possible use as the album cover of Janet Jackson's forthcoming "20 Years Old." For one week, 33 images of Jackson will be available on Yahoo, which can be downloaded and "remixed" to create an original album cover. Four finalists -- as determined by Janet -- will see their designs appear on select publicly distributed copies of the album, which will be released in stores on Sept. 26.

o Mobile Video Developer SmartVideo Raises $9 Million

Atlanta - SmartVideo Technologies, a developer of mobile video delivery technology, announced on Tuesday that it has raised $9 million through a private placement of its shares. Atlanta-based SmartVideo's technology supports Windows Mobile-based smartphones, PDAs and Pocket PCs, and Symbian OS devices with Real Player. The company says it is also testing software that will expand compatibility on a larger selection of phones. SmartVideo counts ABC News, Fox Sports, MSNBC, E! Entertainment and The Weather Channel among its partners, and claims to be the first mobile video company to offer interstitial advertising on mobile devices. SmartVideo will use the funds for working capital, and to expand its marketing and service activities.

o French Video Compression Firm Actimagine Raises $3.75 Million

Paris - Actimagine, a French developer of advanced video compression technologies, announced on Tuesday that it has raised $3.75 million in financing from GRP Partners. Paris-based Actimagine developed the Mobiclip software video codec, which has been used by content providers including Sony Pictures Digital to deliver full-length, full-screen, 30 frames per second movies on 128MG memory cards. Handset makers Nokia and Sony Ericsson are also bundling new smartphones with Mobiclip cards containing full-length movies, while Nintendo licensed the company's technology to deliver video playback for its Game Boy Advance and DS handheld game devices. The company will use the funds to accelerate its business development in the U.S. and Japan.

o Video-Sharing Site Blip.tv Raises First Round Funds

New York - Video-sharing site Blip.tv, which is currently in beta and offers tens of thousands of user-created video blogs, announced on Tuesday that it has raised an undisclosed sum in its first round of financing, from private investors. New York-based Blip.tv offers free technology that lets users post their videos and offers free storage for their video. The company says it will not allow copyrighted media or pornography on its site, adding that it will make money from advertising, professional accounts and licensing its software and services to third parties. Blip.tv says video uploaders have the choice of whether or not to include ads on their videos, with revenue to be split evenly with the company.

Los Angeles - News Corp.'s MySpace social networking site on Tuesday announced the launch of MySpace Comedy, a section that will feature pages for more than 7,500 comedians and audio and video content from comedy club partner The Improv. The site will allow comedians to post tour dates and share audio and video clips of their stand-up routines. It will also spotlight broader comedy events around the country, aggregate funny viral videos and offer forums where members can trade jokes and talk about comedians. o N.Y. Times: Hong Kong Recruits Boy Scouts to be Internet Copyright Police

New York -
The New York Times reported on Tuesday on a new program in Hong Kong that will recruit 200,000 youths from groups like the Boy Scouts to monitor Internet discussion groups, and report people uploading copyrighted materials to customs officials. The reports will then be forwarded to the Motion Picture Association of America and International Federation of the Phonographic Industry. "We are not trying to manipulate youths and get them into the spy profession. What we are just trying to do is arouse a civic conscience to report crimes to the authorities," Tam Yiu-keung, the Hong Kong Excise and Customs Department's senior superintendent of customs for intellectual property investigations, told The Times.

The Manager, Integrated Marketing will build ABC Family’s integrated marketing tactics into unique, creative brands that service both our network and our advertisers in a vibrant and distinctive way that allows our creative to stand out from the competition to target adults 18-34 creatively and adults 18-49 for sales. The objective will be bring new audiences to the network by expressing and communicating the energy, diversity, humor and emotion of the new ABC Family brand.
