o TiVo Awarded $89.6 Million in EchoStar Patent Case; Injunction Stayed

Alviso, Calif. - TiVo, the maker of digital video recorders, announced yesterday that a federal court has granted its request for an injunction against satellite TV provider EchoStar Communications (DISH Network), and awarded the company $89.6 million in damages for patent infringement. However, EchoStar today won a temporary stay of the injunction from the Federal Circuit Court of Appeals in D.C., which will allow it to continue to sell and distribute its digital video recorders for the time being. TiVo sued EchoStar in 2004, alleging the company's digital video recorders infringed on TiVo's "Time Warp" patent on basic digital video recorder technology. A jury ruled in April that EchoStar had willfully infringed on TiVo's patent, and a federal judge in Texas yesterday granted TiVo's motion for a permanent injunction against the manufacture or sale of a number of EchoStar's DVR models. "TiVo has a long list of licensees in the consumer electronics, cable and satellite markets, and we will continue to license our technology under appropriate circumstances and arrangements. We will also continue to vigorously defend our intellectual property for the benefit of our licensees and shareholders," the company said. EchoStar said it will make modifications to both existing forthcoming DVR models. "We continue to believe the Texas decision was wrong, and should be reversed on appeal. We also continue to work on modifications to our new DVRs, and to our DVRs in the field, intended to avoid future alleged infringement," the company said.

o Apple Investigation Finds No Forced Labor at Chinese iPod Plant

Cupertino, Calif. - Apple announced on Friday that an internal investigation into working conditions at a Chinese plant where its iPods are made found no forced labor, but did reveal workers exceeding limits of 60 hours and six days of work per week. A report in the Mail on Sunday, a U.K. newspaper, alleged that workers lived in on-site dormitories at the Foxconn plant and were forced to work 15-hour shifts for as little as $50 a month. "The team reviewed personnel files and hiring practices and found no evidence whatsoever of the use of child labor or any form of forced labor," Apple said in a report on its website. The company did find several instances where workers were forced to "stand at attention" as a disciplinary measure, and stated that it would aggressively train managers and employees to prevent similar tactics. Apple's investigation found that workers at Foxconn exceeded 60 hour-per week overtime limits 35% of the time, and worked more than six days in a row 25% of the time. The company has ordered the supplier to enforce its overtime limits. Apple added that it has hired Verite, a consulting firm that studies workplace standards, to monitor the factory. Plant employees were found to be paid the minimum wage in southern China's Shenzen province -- about $100 a month. Apple has sold more than 50 million iPods since 2001.

o Apple, Scandinavian Consumer Agencies to Discuss iTunes Policies

Helsinki - Apple has asked for a meeting with Scandinavian consumer rights agencies to discuss their allegations its iTunes and iPod are violating their countries' laws allowing free use of legally purchased products, Reuters reported. Consumer rights agencies in Denmark, Norway and Sweden wrote Apple in June to air their complaints; Apple responded in writing that it may be willing to change some of its practices in the countries, but stopped short of offering to open iTunes songs to play on rival players. Sweden's acting consumer ombudsman Marianne Abyhammar told Reuters the parties hope to arrange a meeting in Oslo soon, possibly in September.

o California Lawmakers Vote to Overhaul Cable TV Franchising Process

Thousand Oaks, Calif. - The California Senate Appropriations Committee voted yesterday to overhaul the state's cable franchising process, approving a bill that would allow telecommunications firms to more easily launch digital video services in California. The bill has already passed in the Assembly and a Senate subcommittee, and is expected to be considered in the California Senate later this month. Verizon, which has invested "hundreds of millions of dollars" to build a new fiber-optic network to offer its FiOS TV digital TV service, lauded the vote. "Cable prices have risen 86 percent over the past 10 years, according to the Federal Communications Commission, yet in markets where there is a choice of cable providers, consumers pay 15 percent less for video service, on average," said Verizon West region president Tim McCallion.

o YouTube in Talks With Record Labels to Add Free Music Videos

New York - Video-sharing site YouTube said this week that it is in negotiations with record labels on distributing their music videos on its site, Reuters reported. "What we really want to do is in six to 12 months, maybe 18 months, to have every music video ever created up on YouTube," co-founder Steve Chen told Reuters. "We're trying to bring in as much of this content as we can on to the site." The business model is being developed cooperatively with all the major labels, but YouTube said it will offer videos for free, in a format unlike the paid videos available on iTunes or the MTV-like Yahoo Music service. The company also will add community features, like allowing users to embed videos on their personal YouTube pages.

o EMI in Deal to Preload Music Videos on Microsoft's Zune Player

New York - Major record label EMI this week announced a deal with Microsoft to distribute its music videos pre-loaded on Microsoft's forthcoming Zune portable digital media player. Reuters reported that EMI believes other labels are in talks with Microsoft, and Universal confirmed negotiations with the company. The Zune player and complementary digital media store -- Microsoft's bid to compete with Apple's dominant iPod and iTunes combination -- are rumored to feature wireless capabilities that will allow owners to share media between the devices. Microsoft is expected to launch the Zune player and service in time for the 2006 holiday shopping season.

o Anti-piracy Firm Macrovision Prices $240 Million Notes Offering

Santa Clara, Calif. - Macrovision, a developer of anti-piracy and content production technologies, said that it has priced $240 million in senior notes due in 2011. The Santa Clara, Calif.-based company said that it is selling the notes to qualified institutional buyers, and will use part of the proceeds to repurchase up to $50 million in stock. The news sent company shares up 7% in heavy trading on the Nasdaq.

o Phantom Abandons Console Plans; Game Service to be PC Software

Seattle -
Phantom Entertainment (formerly Infinium Labs) this week abandoned plans to develop its own PC-based video game console, instead announcing that its long-delayed Phantom Game Service will now consist solely of software developed for Windows-based PCs. "The company intends to modify the Phantom Game Service software to run as client software on personal computers operating Windows XP and Windows XP Media Center operating systems," reads a note on the company's site. Originally announced in 2002 as an on-demand PC games service that would run on a proprietary receiver, Infinium Labs failed to deliver the product despite showing a working prototype at E3 in 2004.

Sega Amusements USA, the Japanese game developer's coin-operated arcade games unit, on Friday introduced a new massively multiplayer online platform for coin-op games.
