o Napster Opposes RIAA Request for Summary Judgment

Redwood City, Calif. -- Napster filed court documents this week that
register its opposition to the Recording Industry Association of America's
request for a summary judgment in its copyright infringement lawsuits
against the file-sharing service. A summary judgment would be granted if
Judge Marilyn Hall Patel finds that the RIAA's claims against Napster are
justified to the point that the matter does not need to go through a
lengthy trial. Redwood City-based Napster, which has been offline since
July 2, argued in its filing that there are many more issues that need to
be resolved at a full trial.

o Band's Message Board Taken Down After Secret Service Requests

Seattle, Wash. -- A message board on the website for rock group Rage
Against the Machine has been taken down after the board's host was
reportedly asked to do so by the U.S. Secret Service because of
"inflammatory posts," NME.com reported on Friday. Seattle-based Infoprop
provided hosting services for the message board, which lets fans post
their thoughts on music and anything else they like. A note of the site
from the band says that Infoprop "will no longer donate their services to
keep this message board running in light of repeated phone calls they have
received from the Secret Service with regards to inflammatory posts on
several of the forums." A temporary version of the board is currently
being hosted by Los Angeles-based ArtistDirect.

o Excite@Home Sells E-Greeting Card Firm BlueMountain for $35 Million

Redwood City, Calif. -- High-speed Internet access provider Excite@Home
announced that it has sold its electronic greeting card business
BlueMountain.com to Cleveland-based American Greetings for $35 million in
cash. As part of the agreement, BlueMountain.com will remain the preferred
provider of electronic greetings on the Excite network for the next three
years, and Excite@Home has agreed to purchase $3 million in ads on the
AmericanGreetings.com and BlueMountain.com websites. Redwood City-based
Excite@Home has faced financial strain of late -- independent auditors
hired by the company recently voiced their doubt as to whether it will be
able to remain in business, and both Cox and Comcast said they would no
longer use the company's network to offer cable modem-based high-speed
Internet to their cable TV subscribers.
