o WSJ: Facebook in Talks With Yahoo on Potential $1 Billion Sale

New York - Facebook, the second-largest online social network with 9.5 million members, is in talks to be acquired by Yahoo for a sum approaching $1 billion, The Wall Street Journal reported on Thursday. Facebook has previously held negotiations with both Microsoft and Viacom -- which also bid on MySpace, but lost out to News Corp.'s $580 million winning bid. BusinessWeek reported in March that Palo Alto, Calif.-based Facebook rejected a $750 million buyout offer, hoping to see a $2 billion asking price.

o Google Appeals Belgian Court Ruling, Fines Over Use of News Clips

Brussels - Google has appealed a Belgian court ruling barring it from publishing snippets of news stories from the country's French- and German-language newspapers on its Google News website, Reuters reported. The company has also asked for a suspension of part of the ruling that fines the company the equivalent of $636,000 a day, beginning Sept. 5, for not posting the ruling on its website -- an action Google has still not taken. "We argued that posting the link on the home page in Belgium is unnecessary given how much publicity this court case and the judge's decision have received," Google spokeswoman Rachel Whetstone told Reuters. The company has, though, removed all of the news story snippets in question from the Belgian version of Google News, and said it would do the same for any publisher upon request. Belgian newspaper copyright agency Copiepresse initially sued Google for copyright infringement, arguing that the company should compensate the publishers for using their headlines and fragments of lead sentences on the site, which currently does not feature advertisements other than links to other Google services. Google was also sued by the news organization Agence France Presse in the U.S., and has since removed their articles from Google News.

o Warner Employees File for Patent on DVD, Blu-ray, HD DVD Combo Disc

Los Angeles - Three employees at Warner Bros. have filed a patent application for a "multilayer dual optical disk" that would be able to carry both Blu-ray and HD DVD content on one side, and standard DVD or CD on the opposite side, NewScientist.com reported. The multi-purpose disc wouldn't tip the scales in the next-generation DVD format war between Sony's Blu-ray and Toshiba's rival HD DVD, but would surely please both manufacturers, and retailers faced with creating shelf space for both new formats while continuing to stock standard DVDs. "From the standpoint of a manufacturer, it is disadvantageous to have to manufacture and distribute three different types of disc formats to satisfy consumer demand for one product -- such as a motion picture," the patent application states. "Moreover, multiple formats of DVD discs create retail and consumer confusion as to which format(s) to acquire or buy." Warner Bros. will be the first studio to sell a film in all three formats -- DVD, Blu-ray, and HD DVD -- simultaneously with the Sept. 26 release of "The Lake House."

o George Lucas Donates $175 Million to USC Film School

Los Angeles - "Star Wars" director George Lucas has donated $175 million to the University of Southern California's (USC) School of Cinematic Arts, in what figures as both the largest gift ever received by the school and the largest known contribution to a U.S. film school. "I'm very fortunate to be in a position to combine my two passions and to be able to help USC continue molding futures of the moviemakers of tomorrow,'' Lucas said in a statement. Part of the donation will go to construction of two new buildings at the film school, while $100 million will go towards an endowment.

o Yahoo Sells Jesse McCartney Album in Unprotected MP3 Format

Sunnyvale, Calif. - Yahoo is selling former boy band pop singer Jesse McCartnery's new album for $9.99 in the MP3 format, usually shunned by major record labels because it can be easily copied onto file-sharing networks, but embraced by consumers because it plays in all portable players. The album, "Right Where You Want Me," was authorized for distribution in both MP3 and Microsoft's WMA format by Disney-owned Hollywood Records. The vast majority of downloads from major labels sold at retailers like iTunes feature digital rights management technology, which makes it difficult for them to be copied, or in the case of iTunes, ties them to a specific player like the iPod. Some retailers like eMusic -- which carries mainly independent music -- sell their entire catalogs in the MP3 format. Yahoo also previously offered a single from Epic Records/Sony BMG artist Jessica Simpson in MP3 format.

o Digital Watermarking Firms Form Industry Trade Group

Los Angeles - A group of companies that develop digital watermarking technology, including Cinea, Digimarc, Philips, Thomson and Verance, has formed the Digital Watermarking Alliance (DWA), a trade group that will promote the value of the technology to content owners, industry, policy makers and consumers. The group said digital watermarks are deployed with billions of objects, and that hundreds of millions of watermark detectors are present in the market. "With movies, music and photos increasingly being distributed and shared digitally across numerous mediums, and printed materials such as IDs, financial instruments and product packaging at risk to counterfeiting, fraud and theft, protecting the rights and integrity of these assets and enabling legitimate uses has become critical," the group said. Other companies comprising the 12 DWA initial members include GCS Research, Jura, MediaGrid, Media Sciences International, Signum, Teletrax and Verimatrix.

o Bertelsmann's Arvato Licenses AIM Catalog for P2P Distribution

Berlin - Arvato Mobile, a unit of German media conglomerate Bertelsmann that distributes mobile entertainment content, announced on Thursday that it has signed a licensing agreement with the Association of Independent Music (AIM), which represents over 900 record labels. Under the deal, AIM's catalog will be made available as digital downloads through Gnab, a licensed peer-to-peer distribution network, with deals for subscriptions and video downloads expected to follow shortly. Gnab currently powers online stores for German services jpc and in2movies, as well as Spain's PixBox. Gnab users can browse available titles both on the computers of other users within a particular country, as well as from a centralized server. Users who make their files available for sharing then earn rewards set by each individual retailer.

o Indian Online DVD Rental Service Seventymm Raises $7 Million

Bangalore, India - Seventymm, an online DVD rental service in India, has received a $7 million investment from Matrix Partners India. Bangalore-based Seventymm currently claims 7,500 customers, and stocks a catalog of more than 10,000 DVD titles; the company aims to count 1 million subscribers within five years. Seventymm will use the funds to expand its service into additional cities in India.

o Online News Distributor Voxant Raises $10.5 Million

Reston, Va. - Voxant, a company that distributes news across the Internet for media companies, said on Wednesday that it has raised $10.5 million in its second round of funding. SoftBank Capital and Court Square Ventures co-led the round, which also included participation from previous investor Longworth Venture Partners. The company plans to use the funds to further grow its core network, which publishers use to distribute video, print, audio and still photo news content to thousands of partner websites and blogs. Reston-based Voxant said that its advertising-supported service is free to Web publishers, and provides revenue to both originating content providers and distributors. Its clients include Reuters, MSNBC, CBS and Bloomberg.

Tokyo -
Microsoft will launch an HD DVD player accessory for its Xbox 360 video game console in Japan on Nov. 22, Reuters reported. The separate HD DVD drive accessory will sell for $177, which when added to the $399 price tag of Microsoft's premium Xbox 360 still undercuts the $599 price of Sony's forthcoming PlayStation 3, which will ship with an embedded Blu-ray drive. So far, Microsoft has sold just 160,000 Xbox 360 consoles in Japan, according to sales data from Enterbrain.

o Matsushita Introduces 2 Blu-ray DVD Recorders for Japanese Market

Osaka, Japan - Japan's Matsushita (Panasonic) plans to launch two new Blu-ray DVD recorders that can also play pre-packaged Blu-ray discs in Japan on Nov. 15. A $2,045 model features a 200GB hard drive, while a 500GB model will sell for about $2,560. Toshiba recently launched an HD DVD recorder that also plays HD DVD discs, while Sony will release its own Blu-ray DVD recorder later this year. Matsushita did not announce release details for the devices in the U.S.

o Yale to Offer Video Lectures, Course Materials Online

New Haven, Conn. -
Yale University announced on Thursday that it is currently producing digital videos of select undergrad courses that it will make available for free on the Internet, as part of an initiative by the Ivy League school to make its educational materials more widely available. In addition to lecture videos, the project will offer full transcripts in several languages, syllabi and other course materials for seven courses when it launches online in the fall of 2007.

o The Orchard Licenses Catalog to Chinese Music Store The100.cn

The Orchard, a digital distributor of independent label music, announced on Thursday that it has signed a licensing agreement with top100.cn, China's largest legal online music service. The deal makes New York-based The Orchard's catalog available for legal download in China. Market research firm In-Stat has predicted that the Chinese digital music market is poised to grow at a compound annual rate of 317% between 2005 and 2008.

Custom software developer Sigmer Technologies announced that it has developed a database to house the archives of the British Film Institute (BFI). The archives include over 810,000 British and international film and television titles; the biographies and filmographies of 1.2 million actors, directors, producers and film and TV professionals; 23,000 festival and event listings; and 210,000 organizations. Brighton, England-based Sigmer also developed a search engine for the database. The BFI launched the Film and TV Database as part of an initiative to make its Archive more widely available via digitization and the Web.

Richard Branson's Virgin Group has launched a text message-based game that will award prizes and donate all proceeds to Virgin Unite, the company's new global charitable arm. The game is a "Limbo Auction" from Burlingame, Calif.-based Limbo 41414, where players try to place the lowest unique bid, or the lowest amount that no other person has also placed as their bid. The first two bids are free and thereafter cost 99 cents; for each bid, players also receive points redeemable for prizes in Limbo's store. o Microsoft Displays 110 HD Xbox 360 Titles at Tokyo Game Show

Tokyo -
Microsoft showed a library of nearly 110 high-definition game titles for its Xbox 360 console at the Tokyo Game Show this week, which will be available in Japan in the fall. In addition, the company announced that it will release an update that will allow the Xbox 360 console to output both game and video content at full 1080p resolution, currently the best high-definition standard. Along with Xbox 360 titles like "Blue Dragon" from Microsoft Game Studios, the company announced plans to hold a "Pac-Man" World Championship in early 2007 via its Xbox Live Arcade service for the Xbox 360.

o Sega to Publish PSP Titles from Deep Fried Entertainment

Tokyo -
Tokyo-based game publisher Sega has announced a partnership with Vancouver, Canada-based developer Deep Fried Entertainment, to create titles for Sony's PSP handheld. The studio was launched in 2005 by five industry veterans who have worked on titles including "Need for Speed: Underground" and "Baldur's Gate." Sega said the deal underscores its increased emphases on Western content development, as also evidenced by similar recent deals with Silicon Knights, Obsidian Entertainment, Monolith Productions and Pseudo Interactive, and acquisitions of The Creative Assembly, Secret Level and Sports Interactive.

Disney's Buena Vista Games announced on Thursday that it will ship "Spectrobes" for Nintendo DS worldwide on March 15, 2007. Developed by Kyoto-based Jupiter Corporation, the game is based on an original anime property developed by Buena Vista Games, and will be accompanied by a series of six two-minute webisodes that flesh out the storyline.
